There is a limitation on the ability of a patent owner trying to successfully assert the patent in case of civil litigation i.e., the accused infringer’s right to challenge the validity of a patent. Civil courts hearing such cases can often do declare a patent invalid. Therefore the description and specifications as mentioned in the patent application should be made clearly known to the patent lawyers fighting for the ingenuity of the invention. Patent lawyers are required to study the provisional patent application too.
